ADULT WAIVER, RELEASE OF LIABILITY,
ASSUMPTION OF RISK, INDEMNITY,
AND CANCELLATION AGREEMENT
UNDER THE STARS WEEKEND OUTDOOR RETREATS
I wish to participate in the Under the Stars weekend retreat(s), including but not limited to outdoor activities, hiking, workshops, group discussions, wellness sessions, movement practices, meals, campfire gatherings, use of facilities, and any other related activities (collectively, the “Activities”) organized by Serial Nomad, a sole proprietorship owned and operated by Rozanne Pilbeam (the “Organizer”).
I acknowledge that I would not be permitted to participate in the Activities unless I signed this Agreement.
1. ASSUMPTION OF RISK
I acknowledge that participation in the Activities involves inherent risks, dangers, and hazards that may result in serious personal injury, illness, emotional distress, property damage, or death. These risks include, but are not limited to: slips, trips, and falls; uneven or natural terrain; weather conditions; wildlife encounters; fire hazards; food-related illness or allergic reactions; physical exertion; emotional or psychological stress; equipment failure; the actions or negligence of other participants; and risks associated with outdoor or remote locations, including delayed access to emergency medical care.
I freely and voluntarily accept and fully assume all such risks, whether known or unknown, foreseeable or unforeseeable, including risks arising solely or partly from the negligence of the Organizer or those defined below as the “Releasees.”
I confirm that I am physically and mentally capable of participating and that I have disclosed any relevant medical conditions, allergies, or limitations.
2. RELEASE OF LIABILITY
To the fullest extent permitted by law, I hereby release, waive, and forever discharge Serial Nomad and its owner Rozanne Pilbeam, and their employees, contractors, facilitators, volunteers, venue owners, property owners, agents, representatives, successors, and assigns (collectively, the “Releasees”) from any and all claims, demands, losses, damages, actions, or causes of action arising out of or related to my participation in the Activities, including claims arising solely or partly from the negligence of the Releasees.
I agree that I will not commence or maintain any lawsuit or claim against the Releasees in relation to the Activities.
I understand that this release includes any claims based on negligence, whether active or passive.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, costs, and expenses (including legal fees on a solicitor-and-client basis) arising from my participation in the Activities, any damage or injury I cause to others or their property, or any breach of this Agreement.
4. LIMITATION OF LIABILITY
If, notwithstanding this Agreement, the Organizer is found liable for any loss or damage, such liability shall be limited to the total amount paid by me to participate in the retreat. Under no circumstances shall the Organizer be liable for indirect, consequential, or incidental damages, including travel expenses.
5. MEDICAL CONSENT
In the event of illness or injury, I authorize the Organizer to secure medical treatment on my behalf if I am unable to do so. I agree to be fully responsible for any and all medical or related expenses incurred. I understand that the Organizer does not carry or provide health, medical, or disability insurance for participants.
6. NO PROFESSIONAL ADVICE
I understand that any wellness, mindset, or personal development content provided during the retreat is for educational and informational purposes only and does not constitute medical, psychological, legal, or financial advice.
7. PHOTOGRAPHY AND MEDIA RELEASE
I grant the Organizer the irrevocable right to photograph and record me during the Activities and to use my image, likeness, voice, and name for promotional, marketing, and commercial purposes in any media now known or later developed, without compensation. I waive any right to inspect or approve such materials.
8. CANCELLATION, REFUNDS AND FORCE MAJEURE
I acknowledge and agree that retreat fees are subject to the Organizer’s published Booking Terms & Conditions. A $100 portion of the retreat fee constitutes a non-refundable booking fee. Refund eligibility and cancellation timelines are governed by the Booking Terms & Conditions in effect at the time of booking.
The Organizer reserves the right to cancel, postpone, or modify the retreat due to weather, safety concerns, insufficient registration, government restrictions, acts of God, or circumstances beyond her control. In such cases, liability is limited to a refund of amounts paid. The Organizer is not responsible for travel costs or other expenses incurred by participants.
9. FITNESS TO PARTICIPATE AND ACKNOWLEDGEMENT
I acknowledge that I do not have any physical or mental condition that would prevent safe participation. I confirm that I have been given sufficient time to carefully read this Agreement, have had the opportunity and have been encouraged to seek independent legal advice, fully understand the risks and claims I am waiving, and am signing this Agreement freely and voluntarily.
10. SEVERABILITY
If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
11. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.
12. BINDING EFFECT
This Agreement is binding upon me and my heirs, executors, administrators, legal representatives, and assigns.
